Terms of Service & End User License Agreement

Effective date: November 7, 2026 · Last updated: November 7, 2026

These Terms of Service and End User License Agreement (the "Terms") are a legal agreement between you and SwiftCart Media Limited, a company registered in Hong Kong with its business address at Unit B, 3/F., Kai Wan House, 146 Tung Choi Street, Mongkok, Kowloon, Hong Kong ("SwiftCart Media", "we", "us" or "our").

The Terms apply to our website at swiftcartmedia.com (the "Website") and to every mobile or web application published by SwiftCart Media Limited (each an "App"). Together these are the "Services". By downloading, installing, accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Key points: subscriptions renew automatically until you cancel in your Apple or Google account settings; refunds for app store purchases are handled by Apple or Google; deleting an App does not cancel a subscription; and these Terms do not affect any consumer rights you have by law.

1. Eligibility

You must be at least 13 years old, or the minimum age to use online services in your country if it is higher (16 in some EEA countries), to use the Services. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms for you. By using the Services you confirm that you meet these requirements.

2. Licence to use the Apps

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download, install and use the Apps on devices you own or control, for your personal and non-commercial use, as permitted by the usage rules of the app store you downloaded the App from.

The Apps are licensed, not sold. Unless the law allows it, you may not:

  • copy, modify, translate or create derivative works of the Apps;
  • decompile, reverse engineer or disassemble the Apps, or try to obtain their source code;
  • rent, lease, lend, sell, sublicense or distribute the Apps;
  • remove or change any copyright, trademark or other proprietary notices; or
  • get around any security, licensing or purchase restrictions.

3. Accounts

Some Apps let you create an account. You agree to give accurate information, keep your login details secure and tell us promptly at support@swiftcartmedia.com if you suspect unauthorised use. You are responsible for activity under your account. You can delete your account at any time inside the App or by following our Account & Data Deletion page.

4. Purchases, subscriptions and free trials

Some Apps offer paid content, one-time in-app purchases or auto-renewing subscriptions. Before you buy, the App shows the name of the product or subscription, its price, the length of each subscription period, and what you get.

  • Payment: all purchases are made through the Apple App Store or Google Play and charged to your Apple Account or Google account. Their payment terms also apply. Prices may vary by country and may include taxes.
  • Automatic renewal: subscriptions renew automatically at the end of each period, at the same length and current price, unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends.
  • Free trials and introductory offers: if an offer includes a free trial or introductory price, the subscription automatically converts to the regular price when the offer ends unless you cancel at least 24 hours before then. Any unused part of a free trial is forfeited when you buy a subscription.
  • Managing and cancelling: on iPhone or iPad, open Settings → [your name] → Subscriptions. On Android, open the Google Play Store → profile icon → Payments & subscriptions → Subscriptions. Cancelling stops future renewals, and you keep access until the end of the period you've paid for.
  • Deleting an App or your account does not cancel a subscription.
  • Price changes: if a subscription price goes up, Apple or Google will notify you in advance and, where required, ask for your consent before the new price applies.
  • Restoring purchases: use "Restore Purchases" in the App while signed in to the same Apple Account or Google account.

5. Refunds

Because Apple and Google process all in-app payments, refunds are handled by them under their refund policies, and we cannot issue refunds for app store purchases directly.

If you have a problem with a purchase, contact us at support@swiftcartmedia.com and we will do our best to help. Nothing in these Terms limits any right to a refund or remedy that you have under the consumer law of your country.

6. Acceptable use

You agree not to use the Services to:

  • break any law or infringe anyone's rights, including intellectual property and privacy rights;
  • upload or share content that is illegal, defamatory, hateful, harassing, threatening, sexually explicit involving minors, or that promotes violence or self-harm;
  • send spam, malware or other harmful code;
  • access the Services through bots, scrapers or other automated means without our written permission;
  • interfere with, overload or disrupt the Services or their servers, or try to gain unauthorised access to them;
  • impersonate any person or misrepresent your connection with anyone; or
  • get around purchase, licensing, age or security controls.

User-generated content: where an App lets users post content or interact with each other, it includes ways to filter objectionable content, report content and users, and block abusive users. We review reports promptly, normally within 24 hours, and may remove content and suspend or terminate accounts that break these Terms. We have zero tolerance for objectionable content and abusive users.

7. Your content

You keep ownership of the content you create or upload ("User Content"). You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process and display your User Content only as needed to operate and provide the Services to you. This licence ends when you delete the content or your account, except for copies we must keep by law or that remain in backups for the limited periods described in our Privacy Policy. You confirm that you have the rights needed to upload your User Content.

8. AI-generated content

Some Apps may include features that use artificial intelligence to generate text, images or other output. AI output may be inaccurate, incomplete or unexpected, and it is not professional advice of any kind. Check AI output before you rely on it. You are responsible for how you use it, and you must not use AI features to create content that breaks section 6.

9. Our intellectual property

The Services, including their software, design, text, graphics and the "SwiftCart Media" name, are owned by SwiftCart Media Limited or its licensors and are protected by copyright, trademark and other laws. Except for the limited licence in section 2, these Terms do not give you any rights to them. If you send us feedback or suggestions, we may use them freely, with no obligation to you.

10. Third-party services

The Services may include or link to third-party services, such as sign-in providers, payment processors, advertising networks, AI providers and other websites. Those services are governed by their own terms and privacy policies, and we are not responsible for their content or practices.

11. Updates and availability

We may update the Apps to fix bugs, add or change features, or meet legal or platform requirements. Some updates may be required to keep using an App. We try to keep the Services available but do not guarantee they will always be available or error-free, and we may change or stop offering an App or feature. If we stop offering an App with an active paid subscription, we will give reasonable notice where possible.

12. Additional terms for Apps downloaded from the Apple App Store

If you downloaded an App from the Apple App Store, the following terms also apply. If they conflict with the rest of these Terms, they take priority for that App.

  1. Parties. These Terms are between you and SwiftCart Media Limited only, not with Apple Inc. ("Apple"). SwiftCart Media Limited, not Apple, is solely responsible for the App and its content.
  2. Scope of licence. Your licence to use the App is limited to a non-transferable licence to use it on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Family Sharing or volume purchasing may also let other accounts linked to the purchaser access the App.
  3. Maintenance and support. SwiftCart Media Limited is solely responsible for providing maintenance and support for the App, as described on our Support page. Apple has no obligation to provide any maintenance or support for the App.
  4. Warranty. SwiftCart Media Limited is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses due to any failure to conform to a warranty are the sole responsibility of SwiftCart Media Limited.
  5. Product claims. SwiftCart Media Limited, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy or similar legislation.
  6. Intellectual property rights. If a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, SwiftCart Media Limited, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
  7. Legal compliance. You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Developer contact. Questions, complaints or claims about the App should be sent to SwiftCart Media Limited, Unit B, 3/F., Kai Wan House, 146 Tung Choi Street, Mongkok, Kowloon, Hong Kong; email support@swiftcartmedia.com; phone +43 677 63882574.
  9. Third-party terms. You must comply with any applicable third-party terms of agreement when using the App, for example your wireless data service agreement.
  10. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

If any App is distributed with Apple's Licensed Application End User License Agreement instead of a custom licence, that agreement governs your licence to use the App, and the rest of these Terms apply to the extent they don't conflict with it.

13. Additional terms for Apps downloaded from Google Play

If you downloaded an App from Google Play, your use of it is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App or its support. SwiftCart Media Limited is responsible for the App and its content.

14. Client development services

If you hire us to design or build software, that work is governed by a separate written agreement, proposal or statement of work (a "Client Agreement") covering scope, fees, timelines, ownership and confidentiality. If a Client Agreement conflicts with these Terms, the Client Agreement controls for that work. Unless the Client Agreement says otherwise, ownership of custom deliverables passes to the client once all fees have been paid.

15. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, secure or error-free, or that any content will be accurate. Some jurisdictions do not allow these exclusions, so some of them may not apply to you.

16. Limitation of liability

To the maximum extent permitted by law, SwiftCart Media Limited will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the Services. Our total liability for all claims relating to the Services will not exceed the greater of (a) the amount you paid for the relevant App or subscription in the 12 months before the claim arose, or (b) USD 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection laws.

17. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless SwiftCart Media Limited and its directors, employees and contractors from any claims, losses and expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Services. This section does not apply to consumers where the law prohibits it.

18. Termination

You may stop using the Services and delete your account at any time. We may suspend or end your access if you seriously or repeatedly breach these Terms, if the law requires it, or to protect other users. Where reasonable, we will tell you why. Sections 7 (to the extent needed), 9 and 15 to 20 survive termination.

19. Governing law and disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Before starting any formal proceedings, please contact us at support@swiftcartmedia.com so we can try to resolve the issue informally within 30 days. Any dispute that is not resolved informally will be subject to the non-exclusive jurisdiction of the courts of Hong Kong.

If you are a consumer living in the European Union, the United Kingdom or another country with mandatory consumer protection laws, you also keep the protection of those laws and may bring proceedings in the courts of your country of residence.

20. General

  • Entire agreement: these Terms, our Privacy Policy and any Client Agreement are the entire agreement between you and us about the Services.
  • Severability: if any part of these Terms is found unenforceable, the rest stays in effect.
  • No waiver: if we don't enforce a right, that doesn't waive it.
  • Assignment: you may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition or sale of assets, as long as your rights are not reduced.
  • Language: these Terms are written in English. If they are translated, the English version prevails, to the extent permitted by law.

21. Changes to these Terms

We may update these Terms from time to time, for example to reflect new features or legal requirements. We will post the updated Terms on this page and change the "Last updated" date. If a change is material, we will give you reasonable notice in the App or by email before it takes effect. If you keep using the Services after the changes take effect, you accept the updated Terms. If you don't agree, stop using the Services and cancel any subscriptions.
